1.1 These Terms & Conditions (“Agreement”) govern your participation in the Lusso Tan Affiliate Programme (the “Programme”) operated by Lusso Tan (we / us / our).
1.2 By applying to join the Programme, or by participating in it (e.g., promoting our products via your affiliate link), you (“Affiliate” / you) accept and agree to be bound by this Agreement.
1.3 We reserve the right to amend these Terms at any time; any changes will be communicated via the affiliate portal and will apply from the effective date published. Your continued participation constitutes acceptance of those changes.
2.1 “Affiliate Link” means the unique referral URL or code provided to you via Refersion to track your traffic and sales.
2.2 “Qualified Purchase” means a purchase of Lusso Tan products by a new or existing customer referred by you, which meets the criteria set out in clause 5.
2.3 “Tracking Period” means the time window after a click of your Affiliate Link during which you may earn commission for a sale (see clause 5.3).
2.4 “Commission” means the payment due to you for a Qualified Purchase in accordance with clause 5.
2.5 “Net Sale Amount” means the amount paid by the customer for the product(s), excluding VAT, shipping/handling, returns, refunds and cancelled orders.
3.1 To join the Programme you must complete the application via the Refersion platform and provide accurate information about your promotional channels, identity, and payment details.
3.2 We reserve the right to approve or reject applications at our discretion and may terminate or suspend an Affiliate’s participation at any time under clause 9.
3.3 You must be at least 18 years old and legally capable of entering into this Agreement.
4.1 You agree to promote Lusso Tan products in a manner consistent with our brand values, in full compliance with applicable laws (including consumer protection, advertising, data protection, and affiliate disclosure laws).
4.2 You must use the approved marketing materials (e.g., banners, creatives, links) provided via Refersion or by us and may not alter them without our prior written consent.
4.3 You must clearly disclose to your audience that you may receive commission from purchases made via your affiliate links (in line with UK / NI affiliate marketing disclosure requirements).
4.4 You must not:
a) engage in misleading, deceptive, or unethical marketing practices (including spam, forced clicks, cookie-stuffing, fake accounts, or adware).
b) bid on Lusso Tan’s trademarks or brand name in paid search campaigns, unless expressly permitted in writing.
c) create websites or adverts that copy or simulate Lusso Tan’s website or brand to mislead customers.
d) promote coupon offers, cashback or other incentives to your audience without our consent.
4.5 You are responsible for the content and accuracy of any materials you publish in relation to the Programme and indemnify us for any losses, claims or liabilities arising from your breach of this clause.
5.1 Commission Rate: We will pay you a commission of [insert percentage or fixed amount] on each Qualified Purchase you generate. The rate may be changed from time to time with prior notice.
5.2 Tracking: Your Affiliate Link must be used by the customer prior to purchase for you to be eligible for commission.
5.3 Tracking Period: We will track purchases for a period of [insert number] days from the initial click of the Affiliate Link. Only purchases made within this period qualify unless otherwise agreed.
5.4 Returns / Cancellations: If a customer returns a product, cancels an order or obtains a refund, any corresponding commission will be reversed or withheld.
5.5 Payment Terms:

6.1 We grant you a non-exclusive, non-transferable licence to use Lusso Tan’s logos, trademarks, product images and other promotional materials solely for the purposes of promoting the Programme and solely in accordance with our instructions.
6.2 You must not modify, adapt or create derivative works of our materials without our prior written approval.
6.3 All goodwill generated through your use of our brand and marketing materials shall accrue to us.
7.1 We may provide you with access to confidential information (e.g., affiliate performance data, promotional strategies). You agree to treat such information as confidential and not disclose it to any third party without our express written consent.
7.2 Your obligations under this clause shall survive termination of this Agreement.
8.1 You must comply with all applicable data protection laws (including UK GDPR) in relation to any personal data you collect, process or you are provided in the course of promoting us.
8.2 You shall not send unsolicited marketing (spam) to individuals in connection with the Programme. If you engage in email marketing or other direct communications, you must ensure you have obtained the necessary consents and allowed unsubscribe options.
8.3 You shall assist us in responding to any data subject requests or regulatory inquiries related to customers referred by you.
9.1 This Agreement commences when you are approved to the Programme and will continue until terminated by either party.
9.2 We may suspend or terminate your participation at any time for any reason, including (but not limited to) breach of this Agreement, fraudulent activity, misrepresentation, violation of our brand guidelines, or inactivity for [insert period, e.g., 12 months].
9.3 Upon termination you must immediately cease use of your Affiliate Link, remove our promotional materials from your channels, and you will forfeit rights to future commissions except those previously earned from valid Qualified Purchases (subject to returns/adjustments).
9.4 Clauses 6 (Intellectual Property), 7 (Confidentiality), 10 (Liability), and any other provision which by its nature should survive termination, shall continue to apply after termination.
10.1 To the maximum extent permitted by law, we exclude all liability for indirect, special or consequential losses arising under this Agreement.
10.2 We make no warranties or guarantees regarding your income or performance through the Programme. You accept that results will vary and are not guaranteed.
10.3 You shall indemnify and hold us harmless from any claims, losses or liabilities arising from your participation in the Programme, your promotional activities, or your breach of this Agreement.
11.1 Nothing in this Agreement shall create a partnership, joint venture, agency, employer/employee relationship or franchise between us and you.
11.2 You have no authority to bind us or incur any obligation on our behalf.
12.1 This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of [insert e.g., Northern Ireland / England & Wales].

13.1 If any provision of this Agreement is held invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
